01
About these terms
These terms apply when you use this website or work with Cosmerg. For paid work, your written proposal and these terms together form our agreement. If the two ever conflict, the proposal wins.
02
Engagements and scope
Every paid engagement starts with a written proposal that sets out the scope, deliverables, timeline, and quote. We only start once you've accepted it.
If you'd like something outside the agreed scope, we'll quote it before doing it. We never bill for unapproved work.
03
Quotes and payment
- Quotes are fixed for the scope described in your proposal.
- Payment terms, including any deposit, are set out in the proposal.
- Fees for first steps like a Scan or Map sprint are credited as described in your proposal.
- Care plans are billed monthly and can be cancelled any time, effective at the end of the billing period.
04
Who owns the work
Once paid, you own the code, designs, and other deliverables we create for you. Work lives in your repositories and accounts from the start. Open-source components stay under their own licences, and we may reuse general know-how and non-client-specific tooling.
05
Your part
- Give us the access and information we need, and tell us about anything that could affect the work.
- Make sure you have the right to share the code, data, and accounts you give us.
- Review and approve deliverables in a reasonable time.
06
Confidentiality
We keep your code, data, and business information confidential and use it only to deliver your project. We're happy to sign a separate NDA before you share anything.
07
Preflight checks
Free Preflight checks review only what is publicly reachable at the URL you give us. We never attempt to log in, bypass access controls, or test beyond that. A Preflight review is guidance, not a guarantee that your application is free of vulnerabilities.
08
Warranties and liability
We do our work with care and to the standards described on this site, including the Cosmerg Security Standard. No software can be guaranteed bug-free or completely secure. Our total liability for any engagement is limited to the fees you paid for it, except where the law doesn't allow such a limit.
09
Ending an engagement
Either of us can end an engagement with written notice. You pay for work completed up to that point, and we hand over everything produced so far, remove our access, and help you rotate credentials.
